1. Agreement to terms
These Terms of Service ("Terms") form a binding agreement between you ("Customer," "you") and {{ shop_name }} ("VYRA BODY," "we," "us"). By accessing, browsing, or purchasing from this website, you agree to be bound by these Terms.
2. Eligibility
You must be at least 18 years old to purchase from {{ shop_name }}. By placing an order you represent that you meet this requirement and that all information you provide is accurate.
3. Products and pricing
All products are subject to availability. We reserve the right to limit quantities, discontinue products, and modify prices at any time without notice. Prices are listed in U.S. dollars (USD) and do not include applicable sales tax, which will be calculated at checkout based on your shipping address.
While we work to display product information accurately, occasional errors in description, pricing, or imagery may occur. We reserve the right to correct any errors and to cancel any orders placed at incorrect prices, even after order confirmation.
4. Order acceptance and cancellation
Order confirmation emails are receipts, not acceptance. {{ shop_name }} reserves the right to refuse or cancel any order for any reason, including (but not limited to) suspected fraud, pricing errors, inventory issues, or violations of these Terms. If we cancel your order, you will be fully refunded.
You may request order cancellation by emailing {{ email }} within 1 hour of placing your order. After 1 hour, orders enter fulfillment and cancellation may not be possible.
5. Medical disclaimer
VYRA BODY products are premium compression garments designed for post-operative recovery and daily wear. They are not classified as FDA-cleared medical devices and are not intended to diagnose, treat, cure, or prevent any disease or medical condition.
Content on this site, including blog posts, product descriptions, and the Recovery Stage Guide, is provided for general informational purposes only and does not constitute medical advice. Always follow your surgeon's or healthcare provider's specific instructions regarding post-operative compression, timing, and care. If your surgeon's instructions conflict with anything on this site, follow your surgeon.
{{ shop_name }} is not liable for any health outcome resulting from use, misuse, or non-use of our products. Use of our products is at your own risk and discretion.
6. Intellectual property
All content on this site — including the VYRA BODY name and logo, product names, designs, photographs, copy, graphics, and trade dress — is the property of {{ shop_name }} or its licensors and is protected under U.S. and international intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content without our prior written permission.
7. User submissions and reviews
If you submit reviews, photos, or other content to {{ shop_name }} (collectively, "Submissions"), you grant us a perpetual, worldwide, royalty-free, irrevocable license to use, reproduce, modify, publish, and display the Submission in any medium for any business purpose. You represent that your Submission is original, does not violate any third party's rights, and that you have all necessary consents (including from any other people pictured).
8. Hygiene and final sale
Due to the intimate nature of compression garments, any product removed from its sealed hygiene packaging is considered final sale and is non-returnable. This protects every customer. See our Refund & Exchange Policy for full details.
9. Wholesale and partner accounts
Wholesale customers (plastic surgery practices, recovery houses, medical spas, retailers) are governed by separate wholesale terms agreed upon at account opening. The retail Terms above apply to wholesale buyers only where wholesale terms are silent.
10. Promotions, codes, and gift cards
Discount codes and promotions are subject to specific terms and may not be combined unless explicitly stated. Codes cannot be applied to prior orders, wholesale orders, or already-discounted items. Gift cards do not expire and have no cash value.
11. Limitation of liability
To the maximum extent permitted by law, {{ shop_name }} and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or use — arising from your use of the products or this site, even if advised of the possibility. Our total liability for any claim shall not exceed the amount you paid for the specific product giving rise to the claim.
12. Indemnification
You agree to defend, indemnify, and hold harmless {{ shop_name }} from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms or your misuse of the products or site.
13. Governing law and dispute resolution
These Terms are governed by the laws of the State of Florida, without regard to conflicts of law principles. Any dispute arising from these Terms or your use of the site shall first be subject to good-faith negotiation. If unresolved, disputes shall be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, conducted in Miami-Dade County, Florida, in English. You waive any right to participate in a class action or class arbitration.
14. Changes to terms
We may update these Terms from time to time. Material changes will be notified by updating the "Last updated" date above. Continued use of the site after changes constitutes acceptance.
15. Severability
If any provision of these Terms is found unenforceable, the remaining provisions remain in full force.
